Maharam Sues Valley Forge for Copyright Infringement

Maharam, Paul Smith Group Holdings, Ltd. and Paul Smith Ltd. jointly filed on October 27, 2010, a copyright infringement complaint against Valley Forge Fabrics at the United District Court, Southern District of New York. Under the complaint, Maharam and Paul Smith allege that Valley Forge Fabrics produced an unauthorized replica of the copyrighted pattern Modulating Stripe by Paul Smith, an original Paul Smith design which Maharam produces and sells under exclusive world-wide license. The infringed pattern is among Maharam’s most popular upholstery textiles.

Valley Forge filed an anticipated answer to the complaint, denying that “Modulating Stripe” is a “unique textile design” and alleging that Maharam and the Paul Smith Companies “have suffered no measurable damages” from its actions.
